0views
Have you ever received a fine from a traffic camera in Armenia that you believe was issued unfairly? Mistakes can happen, and every driver has the right to defend their case. TUGANQ.COM provides a detailed guide on how to appeal an administrative act in Armenia.

Before You Start: Assessing the Risks

Before initiating an appeal, it's crucial to understand the potential risks involved:

  • Loss of Discount: When you file an administrative appeal, you lose the opportunity to pay the fine with a 30% discount.
  • Court Costs: If the case proceeds to court, be prepared for additional expenses:
- State fee (court filing fee)
  • Postage and correspondence costs
  • Potential legal/attorney fees
Step 1: Administrative Appeal (Pre-trial Procedure)

This is the first and mandatory step of the appeal process. You have 30 days from the moment you are notified of the violation.

You can submit your complaint in two ways:

  • By Mail: Address your complaint to the Traffic Police of the Ministry of Internal Affairs of the Republic of Armenia.
  • Online via e-request.am: This is the most convenient method.
    • Register on the website.
    • In the "To whom are you addressing your letter?" field, select "Police of the RA" or "Ministry of Internal Affairs of the RA."
    • Attach your complaint and any necessary evidence.
Typically, you will receive a response to your complaint within 30 days.

    Step 2: Judicial Appeal (Court)

If your administrative appeal has been rejected, but you are still confident that you are in the right, you can take your case to court.

    • Deadline: Within 2 months of receiving the rejection notice.
    • Court: The claim must be filed with the Administrative Court of the Republic of Armenia (address: 23 Garegin Nzhdeh St, Yerevan).
    • Required Documents:
    - Claim form (statement of claim)
    • Receipt for payment of the state fee
    • A copy of the decision rejecting your administrative appeal
    • A copy of your passport
    • Postal receipt confirming that the claim was sent to the respondent (the Traffic Police)
Important to remember: If you win the case in court, the state fee you paid will be refunded.
