Is a Patrol Officer in Armenia Obligated to Explain Your Rights and Duties?
Many people in Armenia have encountered a situation where a patrol officer issues a fine but fails to explain the citizen's rights and responsibilities. But is this legal?
According to the legislation of the Republic of Armenia, specifically the RA Law "On the Fundamentals of Administration and Administrative Proceedings," a patrol officer is obligated to explain a citizen's rights and duties. This is enshrined in Part 1 of Article 40 of the law.
Why Is This Important?
Issuing a fine is considered an "administrative act," which initiates an administrative proceeding. In this context, the patrol officer acts as a representative of an administrative body and must explain the citizen's rights and duties as part of the legal process.
What Can You Do If an Officer Fails to Explain Your Rights?
If a patrol officer in Armenia does not fulfill this duty, you have the following options:
- Appeal the administrative act (the fine) based on a violation of procedural norms. According to Part 2 of Article 77 of the law, such a violation can lead to the annulment of the administrative act.
- File a complaint against the officer's inaction to a superior official or the court (Article 69).
- In some cases, you may also demand compensation for damages if you can prove that harm was caused by the failure to explain your rights (for example, you missed the deadline for an appeal).
Failure to explain a citizen's rights and duties can lead to several consequences:
- The annulment of the administrative act (the fine).
- Disciplinary action being taken against the officer.
- The state becoming liable for compensating any damages.
