How to Appeal a Car Insurance (CMTPL) Decision in Armenia: A Complete Guide

The decision made by an insurance company in Armenia after a car accident under a CMTPL policy (known locally as APPA) is not always final. If you disagree with the assessed damage amount or the determination of fault, you have the full right to appeal it. In this guide, we'll walk you through the entire appeal process specific to Armenia.

What Can You Appeal?

There are two main grounds for appealing a CMTPL (APPA) decision:

  • The assessed amount of damage. This is the most common reason for disputes.
  • Liability. The decision regarding which party is at fault for the accident.
  • Why Might Damage Be Underestimated?

    A low damage assessment can happen for both objective and subjective reasons.

    • Overlooked Damage: In major accidents, an expert might simply miss some hidden damages to internal parts.
    • Intentional Lowballing: Sometimes, insurance companies try to save money, hoping the client won't bother to appeal the decision.

    Key Prerequisites

    • A Correct Email Address: All communication during the claims process in Armenia, including official notifications, is done via email. An incorrect email in your contract could cause you to miss crucial appeal deadlines.
    • Automatic Process: If the accident was registered via the ASWA mobile app or by the Police (with no physical injuries), the compensation process starts automatically without you needing to file a claim.

    The Appeal Stages

    There are several sequential options available for an appeal in the Armenian system.

    Stage 1: Additional Examination

    • Who conducts it: Your insurance company.
    • Deadline to apply: 2 business days after receiving the decision notification.
    • Cost: Free of charge.
    • Result: Within 3 business days.
    Stage 2: Re-examination
    • Who conducts it: The Motor Insurers' Bureau of Armenia.
    • Deadline to apply: 5 business days after receiving the decision notification.
    • Cost: Paid service (from 5,000 to 49,000 AMD).
    • Result: Within 3-5 business days.
    • Important: The Bureau's conclusion is considered final within its system. After this stage, you cannot appeal to the Financial System Mediator.
    Stage 3: Final Appeal If you are unsatisfied with the results from the previous stages, your next steps depend on whether you underwent the Re-examination.
    • If you DID NOT undergo a Re-examination:
    - Individuals can either appeal to the Financial System Mediator of Armenia (within 6 months) or go directly to court. Note: appealing to the Mediator forfeits your right to take the same case to court later.
    • Legal entities can only appeal through the court system.
    - If you DID undergo a Re-examination:
    • Your only remaining option is to appeal in court.
    Reminder: To file a lawsuit in court, having a Re-examination conclusion from the Bureau is a mandatory requirement in Armenia.
